& Conditions
All
bookings are made subject to acceptance of the following Terms and Conditions:
Booking requests are
only available to persons at least 18 years of age.
Process
On
receipt of your reservation inquiry, we will contact you by email within
24 hours and provide you with confirmation of availability, villa rental rate
and the amount of deposit required (30% of total rental cost) and a
booking form.
Payment
Standard payment will be by paypal. On receipt of your
booking request, we will send a paypal invoice for payment of your Deposit (or
full payment if less than 30 days from arrival). You can follow the
instructions in the email to pay by credit card. No paypal account is required.
If you have a bank account in Thailand, then bank to bank transfer is
available, please contact us for bank details.
Deposit
Payment (non-refundable)
30%
deposit of the total accommodation cost if more than 4 weeks
(31 days) prior to arrival,
Payment
in full payment if arrival is less than 4 weeks (30 days) prior
to arrival.
After
signing & returning the booking form an initial non-refundable
deposit needs to be paid (see above) No contractual obligation will exist
prior to receipt of funds. A booking is only confirmed once the deposit amount
has been received and we have responded to you via email that your booking is
confirmed. Due to high demand Barefoot Villas Krabi is often booked a long time
in advance and reservations are handled on first come, first served basis.
Balance
Payment
Payment of the
outstanding balance must be received 31 days before the arrival date. We
will send you paypal invoice for the balance 40 days before your arrival date.
We will then send a confirmation email once the payment has been received Please
email us when the payment has been made so we can check for it. Should Barefoot
Villas Krabi not receive the balance by the due date, we reserve the right
to cancel the booking reservation.
The
full balance of your booking arrangements must be paid within 31 days
prior to your arrival date, whether demanded by us or not.
Failure
to pay the final balance by the due date will result in cancellation of the
reservation and loss of deposit.
Arrival
Within 48 Hours
For last minute
bookings that are made within 48 hours of the date of your intended arrival at
the villa, we require payment in full prior to commencing your stay either via
PayPal or in cash in Thai Baht upon arrival at the villa.
Security
Deposit
A security deposit of
10,000THB is payable to Barefoot Villas Krabi with the payment of the
balance or upon arrival in cash. This is to cover the cost of any damage, breakages
or lost items during the rental period of the villa.
The
security deposit will be returned to you in cash less any such costs.
Payment
Villa rental rates
quoted are on a per day basis and in Thai Baht.
Rental
Rates
Rental rates vary
according to the season and are subject to change without notice. Once the
Guest´s booking is confirmed, the price of the Guest´s reservation is locked
in, even if Barefoot Villas Krabi changes the price on its website after the
Guest´s booking has been confirmed.
Additional
costs
The cost of electricity, mains water,
cleaning and local taxes are included in rental rates.
There
are generally no additional costs, surcharges, taxes in the price quoted
unless otherwise stated in the property description; the booking confirmation;
or reservation voucher. Gratuities for household staff are encouraged and
normal but are left entirely at the Guest´s discretion.
Barefoot
Villas Krabi reserves the right to impose any taxes or other charges which may
be implemented by any government or other regulatory body, which were unknown
at the time of publishing. Barefoot Villas Krabi will tell the Guest promptly
in the unlikely event that it becomes aware that any taxes or charges will
apply to the Guest´s booking.
Changes
& Cancellation Policy
The deposit and final
balance paid are non-refundable. If the booking is cancelled any moneys paid
will not be refunded. Failure to pay the final balance by the due date will
result in cancellation of the reservation.
Changes to dates
If
guests require a change in the rental date, we will, (subject to availability),
use our best efforts to accommodate guests on an alternative date. If the
alternative dates are during a higher cost rental period (i.e. high or peak)
then additional rental charges will need to be paid. Conversely, if the
alternative dates are during a lower rental rate period, there will be no
refund of the difference in rates.
Transfer of
Bookings
Requests
for transfers must be in writing and come from the person who booked the villa
and must contain full name and contract details of the person taking over your
booking, we also require guest arrival & departure date, names and number
of people in the group. Kindly note that the person taking over the booking
must be aged 18 or over and an administration fee of 10% of booking value will
apply for all transfers.
No
Show
´No
Show´ is deemed to have occurred when on the day of your arrival your confirmed
reservation is not claimed for check-in by 23:00 [11:00 p.m.] and we have not
received nor acknowledged in writing your notice of late arrival. Once ´No
Show´ is established, your entire booking will be considered to have been
cancelled.
Cancellations
by Barefoot Villas Krabi
Alteration
or Cancellation - In the unlikely event that Barefoot Villas Krabi has to
make any changes to confirmed bookings, we will advise you at the earliest
possible date. If a property is damaged or rendered unusable, or if for any
reason beyond our control or due to unexpected circumstances. Barefoot Villas
Krabi reserves the right to cancel the reservation. However, we will
endeavor to locate an alternative property for the required period. If this is
not possible, or you do not wish to be transferred, we will cancel the booking
and refund you in full. Barefoot Villas Krabi shall not be liable for any
further obligations or claims by the guest.
Arrival
& Departure times
- Check In between 2 pm and 6 pm.
- Check out 11am
- Required at check in:
- Cash security deposit of 10,000 THB is payable upon arrival (if not already paid)
- Government-issued photo ID or valid international passport for foreign visitors required for all guests staying at the villa.
- Check out 11 am
- We will do our best to accommodate you if you are planning to arrive early (before 2pm) or late (after 6pm)
Access
The Villa and its facilities are available for
the Guest´s full enjoyment during the Rental Period. However, the Owner,
Owner´s Representative, or other staff and contractors may need access to the
Property from time to time (e.g. for maintenance purposes to the house, garden,
swimming pool, utilities and services, or for the purposes of providing
additional services requested by the Guest, etc.). The Guest is required to
give them reasonable access to the Property for these purposes.
Air-Conditioning
The use of
air-conditioning and ceiling fans are the responsibility of all members of the
party. Please ensure that it is only used when the property is occupied. All
windows and doors are to be kept firmly closed when the air-conditioning is in
use and under no circumstances are the units to be left on continuously while
the property is unoccupied. Note: use of electricity is chargeable, see note on electricity.
Complaints
Every
attempt will be made to ensure that Guests have an enjoyable stay. If you have a problem during your stay,
please inform our local Property Manager who will endeavor to put things right.
For the Guest´s complaint to be addressed, the Guest must communicate any
problem whilst on location. If no complaint is reported during the Rental Period,
Barefoot Villas Krabi will assume that the Property was to the Guest´s
satisfaction and no complaint will be entertained.
Barefoot Villas Krabi cannot be held liable for
the breakdown of the supply of water, electricity, internet connection nor of swimming
pool filtration systems as these are beyond our control. However, we will do as
much reasonably possible to avoid and resolve the issue as quickly as possible.
Due
Care of the Facilities
Please treat our villas with care and respect so that others who
come after you may enjoy the villa as well, our Villas are available for
letting on the understanding that the property and contents will be in place
and left in an acceptable clean and tidy condition at the time of checkout and
all that all personal litter put in the bins provided.
As part of this agreement guests are required to take due
care when residing at the villa. Please note that our villas are furnished
with high-quality furniture, bedding, and fittings, please do not sit on
furniture or bedding when you are wet or wearing sun lotion,
move furniture or other items, made for use inside the property
outside. Damages done due to neglect will be charged back to the customer
at full replacement cost. Please consider this if you have young children.
Electricity
Kindly switch off all air conditioning units and and
ceiling fans before leaving & securing the villa.
Electricity
Consumption
Advertised prices include an amount of
electricity as shown below according to the size of the villa,

3-Bedroom Property 250Kwh Per Week
·
4-Bedroom
Property 300Kwh Per week.
This amount is generous & enough for normal
use of the property including the air-conditioning, all electrical appliances
and swimming pool. The cap is set to encourage you to think environmentally and
protect the owner from abuse.
Any additional consumption in excess will be charged
at Thai Baht 0.30 Thai Baht per KWh and be deducted from your security
deposit.
Housekeeping
We provide basic
housekeeping services for 2 days per week. This covers general cleaning of
the villa, tidy the house to change beds and clean the bathrooms and
keeping the pool clean, it does not include cooking, serving, washing
dishes, pots and pans, or to cleaning up after guests or parties.
At
an additional cost you may add on extra maid or cleaning service should
you require it. Our staff can help you with all tasks such as: ironing
clothes, making bedrooms, washing dishes and helping you to prepare food and
serving your guests, please make request and payment for this service prior to
arrival or during your stay.
Linen
& Towels
Towels are normally changed every three (3)
days, Linen every seven (7) days. If more frequent changes required there may be extra charges. Outside laundry
services are also available for a small service charge and must be paid at the
time incurred ask our Service staff for details.
Insurance
It is advisable that the entire party is
covered by comprehensive travel insurance of their own (including cancellation,
flight delays, loss and damage to baggage and other property) and health
insurance (including local treatment, evacuation and repatriation coverage). As
deposits and rental payments may not be refundable after a reservation has been
confirmed, guests should consider an option of this travel insurance to cover
the loss of money paid to the villa in case you might have to unexpectedly
cancel their journey. Barefoot Villas Krabi is not responsible and are held harmless
against all claims including any accidents related to the use of the villa
facilities or locally procured third party services such as, but not limited
to, watercraft, water sports, car or motorbike rental. Barefoot Villas Krabi
shall not be responsible for any delay, additional expense or inconvenience
caused directly or indirectly by events outside Barefoot Villas Krabi´s
control, such as civil disturbances, fires, floods, severe weather, acts of
God, acts of Government etc.
Number
of Guests
The number of people staying at the property
must not exceed the occupancy limit as stated below for your villa except
in the case of infants (under two years old), or unless specifically
authorized. Parties, functions, meetings or any other activity involving
additional guests in the villa are not permitted without previous written
permission, authorized by management. Should Barefoot Villas Krabi find that
the number of people staying at the property exceeds that on the booking form,
additional guests will be subject to a per person, per day surcharge and/or may
be asked to vacate the premises. Barefoot Villas Krabi regrets that no pets are
allowed.
Villa 1 - 4 Bedroom Villa - 8 Guests
Villa 2 - 3 Bedroom Villa - 8 Guests
Villa 3 - 2 Bedroom Villa - 4 Guests
Camping is not permitted on the property or
grounds.
Passport/Travel
Documents expiry date
Important: Check passport(s) expiry date before booking.
Foreigners entering
Thailand must hold a passport valid for at least six months beyond the
date of your entry and at least one blank page for entry stamp, else they may
be refused entry into Thailand.
Power
Outages
Please note that
occasional power cuts and Wi-Fi (internet) outages are island idiosyncrasies in
Ao Nang especially during thunderstorms are out with our control.
Pets
Barefoot Villas Krabi
are regretfully unable to accommodate pets.
Pool
and Outdoor Regulations
Kindly shower before
entering the pool.
The private swimming
pool can be used 24hrs a day, however, please keep the noise down to
taking levels after 10pm as we are in a residential area and the sound
carries a long way.
The pool is not fenced,
and no Lifeguard is on duty. PLEASE DO NOT allow unsupervised children and
non-swimmers to use the pool. All guests are responsible for their own and
their guest´s safety, children should always be supervised especially when
using any of the villa´s facilities (i.e. swimming pool, barbecue, etc.). Any
non-swimmers should always be supervised by a competent adult when using the
pool.
Should a glass become
broken near the pool it is your duty to let us know so that we can call in the
pool maintenance team to sweep the pool to avoid a future accident.
You will not be charged for this, safety comes first.
No running in the villa
- Do be careful floors are slippery when wet! and a trip to the
hospital whilst on holiday is never good idea, please ensure to dry off before
entering the villa and please don't sit on the beds or sofa when
wet, Barefoot Villas Krabi do not accept any responsibility in respect of
death, bodily injury or illness of any person renting or visiting the
villa.
Price
Fluctuation
Once the Guest´s
booking is confirmed, the price of the Guest´s reservation is fully guaranteed,
even if Barefoot Villas Krabi changes the price on its website after the
Guest´s booking has been confirmed. In return for this commitment, no refunds
will be made for any exchange rate fluctuations that would otherwise reduce the
rental cost.
Barefoot Villas Krabi
reserves the right to impose any taxes or other charges which may be
implemented by any government or other regulatory body, which were unknown at
the time of publishing. Barefoot Villas Krabi will tell the Guest promptly in
the unlikely event that it becomes aware that any taxes or charges will apply
to the Guest’s booking.
Registered
Guests
Strictly no unregistered guests to stay at the
villa without notifying our Property Manager beforehand. Thai Immigration law states we must register
all guests staying in the villa with the local immigration office, therefore
please let our Property Manager know of any changes or additions.
Only those persons stipulated on the booking
form may reside at the property as guests. The number of people staying at the
property, including children, must not exceed the maximum capacity indicated in
the property description or elsewhere, except in the case of infants (under two
years old), or unless specifically authorized.
Should the owner or the
Property Manager find that the number of people staying at the property exceeds
that on the booking form or the maximum capacity of the villa, they may, at
their absolute discretion of Barefoot Villas Krabi ask the extra person or
persons to either pay the applicable additional charge as per the published
rate or to vacate the property forthwith.
No camping is permitted
in the property grounds.
Reservations
Reservations are
for a minimum of three (3) nights, with the exception of Peak periods whereby a
minimum of five (5) nights or otherwise agreed is applicable and can
only be made by persons of at least 18 years of age and above.
Provisional
bookings must be made by telephone or email to ensure that the accommodation is
available on the dates you require. A provisional booking will be held for 2 days
to allow you to email the booking form and pay your deposit.
Security
- CCTV
Guests should be aware that there are external
security cameras at various locations around the villas they are primarily
focused on the driveway and perimeter areas and entry / exit doors of the
villas and that these cameras record on a looped system.
Security
- Deposit
A security deposit of 10,000THB is payable to
Barefoot Villas Krabi with the payment of the balance or upon arrival in
cash. This is to cover the cost of any damage, breakages or lost items during
the rental period of the villa.
The occupancy of a rental property is subject
to conditions of Fair Use. Barefoot Villas Krabi accepts fair wear and tear to
the property, it's furniture, equipment, fixtures and fittings. However, damage
above and beyond that, which may normally be considered fair wear and tear,
caused or carried out by the occupant(s) or by guests of the occupant(s), will
be deemed to be the responsibility of said occupant(s) and financial
compensation will be sought. This compensation is not limited to the amount of
the security deposit. In the event of such occurrence, the incident must be
reported to the property owner or their property manager, immediately.
Furthermore, consistent abuse of the property
and/or its contents may result in summary eviction.
The security deposit will be returned to you in
cash subject to an inspection less any such costs.
Security Safe
The Master
bedroom at Barefoot Villas Krabi is equipped with 1 safety box.
Securing
the Villa & Valuables
Guests are responsible for the Property during
the Rental Period and must ensure that all windows and doors are locked
securely when not on the premises; if you do not take appropriate care with
security and a burglary results or if anything goes missing, you will be
responsible for any costs.
Any valuables left at the property are at the
guest´s own risk. Neither Barefoot Villas Krabi, the Owner nor the Owner´s
Representative accepts any responsibility for loss of or damage to Guest(s) or
visitor(s) property.
Social Conduct & Responsibilities
The Guest responsible for making the
reservation is responsible for the behavior of the guests staying at the
Property, as well as visitors to the Property during the Rental Period. Should
any guest(s) or visitor(s) not behave in a suitable manner, specifically but
not limited to the following cases:
- No
illegal drugs at the villa (be aware of severe penalties in Thailand).
- No
firearms, deadly weapons, pyrotechnics are not permitted.
- No
illegal activities with under-age individuals are witnessed (guests would
be summoned to the local police).
- No
Male or female joiners are invited over to the property, as non registered
guests. In line with moral duty and respect for the local employees,
as well as your safety, it is not authorized for you to bring male or
female joiners met on site back to site.
- Any
other illegal or immoral activities are done within the private boundaries
of the property (e.g. illicit pictures and movies).
Failure to observe these rules could result
in loss of your security deposit, or in severe cases result
in immediate eviction, in such a case, this will be treated as a
cancellation of the original booking and no refund would be applicable and
Guest(s) and Visitor(s) may be asked to vacate the premises immediately.
Noise
No excessive noise after 10pm,
sound carries a long way here, we respectfully ask that all guests
& visitors be respectful of our neighbors keep noise levels
outside and around the pool to normal talking levels after 10pm, (no loud
screaming, shouting or loud music).
No Smoking
There is a
strict NO-smoking policy for the interior of the villas including all bedroom´s
toilets etc. We ask all guests to respect this as this is a requirement of the
owner´s insurance policy, if damage by smoking occurs the full cost of any
damage sustained will be the full responsibility of the booked guests.
Your
Duty of Care
You agree to make
sure that the villa is in the same condition when you leave, as it was when you
arrived. You must dispose of any rubbish in the bins provided before you
leave.
Please let us know as
soon as reasonably possible if something gets lost, broken, stained, marked or
damaged during your stay so that we can replace it at once. Depending on what
is broken, we may have to make a charge. Please also ensure that dishes and
pots are cleaned. Towels and sheets can be left in each room.

We make every effort to
ensure that provided information about the property and the descriptions,
photographs and specifications are as accurate as possible, they are meant only
as a guide, in the event of unintentional errors, mistakes or omissions we
cannot accept any liability for these Barefoot Villas Krabi will not be held
responsible for any errors or omissions and no warranty is implied or given.
Please note that specifications, photographs and prices are subject to change
without notice and photographs may be digitally altered and/or cropped for
performance reasons.
Applicable
Law
These terms and conditions and any contract to
which they apply are governed in all respects by the applicable Thai law, and
the Thai courts only shall have jurisdiction in relation to any claim or
dispute arising out of or connected with them.
Liability
Release
No liability is accepted for any injury, loss or damage to
guests and/or their belongings, damage by or to any third party or for damage
to any motor vehicle or its contents. All guests are responsible for their own
and their guest´s safety and children
should be supervised at all times especially when using any of the villa´s
facilities (i.e. swimming pool, barbecue, etc.). Any non-swimmers should be
supervised by a competent adult at all times when using the pool. We do not
accept any responsibility in respect of death, bodily injury or illness of any
person renting or visiting the villa. Therefore, we strongly recommend that you
and all of your party take out fully comprehensive travel insurance at the time
of booking.
Under no circumstances shall Barefoot Villas Krabi be
responsible for any loss, expense, damage, claim or injury either directly or
indirectly, consequential or otherwise whatsoever, caused or incurred, whether
arising in contract or otherwise in law or equity as a result of rendering of
the services or accommodation as described or substituted, or by reason of
military action, revolution or acts of God, or by any agents, employees,
subcontractors, servants or third parties whatsoever supplying any of the
services or accommodation herein or as substituted than those originally
contracted. Barefoot Villas Krabi at its sole and unfettered discretion,
reserves the right to refuse or discontinue service to any person (s) and/or to
rescind any contract for accommodations or guest services.
AGREEMENT
This agreement will be governed by the laws of
Thailand. In the event of controversy arising from the booking and Property
rental that cannot be resolved amicably between the parties.
By making its booking
request, the Guest agrees that these terms and conditions have been read,
understood by all parties and have been accepted and agreed to by the Guest
without reservation and without exception.
If any of the
conditions of this Rental Contract are or become or are deemed to be invalid,
or if there is any omission from any terms and conditions, the remaining terms
and conditions will remain valid and enforceable and cannot be contested.
By making this booking, I/we do hereby agree on
behalf of all persons detailed in our reservation booking list that:

These terms and conditions have been read,
understood by all and have been accepted and agreed to without reservation and
without exception.
II.
That we have the authority and accept financial
responsibility for payment of the booking on behalf of all persons detailed on
the booking.
